Hosting Bot, LLC is dedicated to your satisfaction with our servers. We are happy to work with you to resolve any problems you may encounter. In the case that we cannot resolve your concern, we offer a 1-day refund period on dedicated, managed, and unmanaged KVM instances. We offer a 3-day refund period on all web hosting products. Refunds are only available for initial payments on new services for new clients on their initial purchase. However, we offer no refunds on special or promo offers or custom discounted products, as well as IP add-ons and service add-ons. We also do not offer refunds on Pre-Orders. It is your responsibility to cancel reocurring payments; failure to do so will result in any future payments considered as donations and will not be refunded but will be assigned to your credit balance for use at Hosting Bot, LLC. There is a 20% refund fee for all orders that are completed using Paypal or Stripe starting March 2020. Any breaches to these terms of service as determined by Hosting Bot, LLC will result in the customer being ineligable for a refund.
Affiliates:
We only payout in Credit which can be used on our site. We don’t pay out to live currency at this time.
Cancellations:
Cancellations should be submitted in the client portal via the request cancellation link on the product page. All cancellations must be (7) days prior to service renewal date, or you could be charged for the next month. Failure to submit cancelation [7] days before the due date or while a service renewal invoice is generated, is a Terms of Service violation and may result in immediate service termination or account clousure. Hosting Bot LLC reserves the right to initiate payment of invoices once they are generated, typically (7) days before the due date. It is the client's responsibility when submitting for cancellation to request a refund.
End of Life Products::
From time to time, Hosting Bot, LLC may need to add new products and replace legacy products based on customer demand. In the event that a new product becomes available, you are welcome to upgrade it in the client portal. In the event, we sunset or discontinue a product, we will offer 60 days’ notice and work with customers to meet their needs.
Chargeback and Disputes::
Hosting Bot, LLC works with all of our clients to ensure the best possible experience. We understand that in some cases our products may not meet your needs. Please review our Refunds and Cancellations policies. In the event of a billing dispute, claim, or chargeback with our payment processors, you agree that we may share your account information (including name, address, IP address, account history, and any files stored on our system) with the payment processor. In the event that a fraudulent chargeback or dispute is raised, we may share these details with external 3rd parties such as MaxMind, FraudRecord, and other commercial fraud prevention platforms as well as applicable law enforcement investigations.
Cryptocurrency Payment Policy:
Due to the volatility and transaction fees involved in cryptocurrency-based transactions, any product refund, cancellation, or modifications will be applied as an account credit. We are unable to refund these payments.
Promotions:
From time to time Hosting Bot, LLC may provide promotional offers that modify product pricing. These promotions may expire at any time, when they are used a certain number of times, or based on market conditions.
Price Match:
At Hosting Bot, LLC we will price match any competition price that is verifiable and valid on the competition’s website or advertising.* *Subject to “within reasonable standards”
Price Adjustments:
To remain competitive, we occasionally make changes to our plans and pricing. To have your plan updated to current offerings please contact our billing team. We cannot go back and modify invoices that have already been paid but will be happy to modify your plan for new invoices.
Country Block Policy:
In the event that a Hosting Bot product becomes unavailable or blocked by a business, institution or country firewall we can attempt to move you to a node that is not blocked by your country but you must submit a support ticket. We cannot guarantee product availability from all data centers, and pricing may vary between data centers. Any product cancellation requests outside of our refund period will be governed by our Cancellation policy.
Legal Contact:
Hosting Bot, LLC retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of an issue arising whether it is through violation of this policy or any other illegal occurrence requiring the involvement of law-enforcement agencies. Hosting Bot, LLC regards any communication between parties as confidential, upon the distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from Hosting Bot, LLC you permit us to modify your server, this includes, but is not limited to, and other tasks related to running a VPS server. Any verbal or written statements to compromise our server systems or any other equipment owned by Hosting Bot, LLC will be taken seriously and will result in further investigation and possible legal action. Upon cancellation of payments to Hosting Bot, LLC, your server will be suspended unless prior arrangements are made. Files will be kept as long as possible after termination or suspension, however the guaranteed amount of time is unspecified. Hosting Bot, LLC retains the sole right to stop, start, and modify your server.
Rent to Own (RTO) Policy:
Rent to Own Servers are servers that are owned, operated and the sole property of Hosting Bot, LLC until Hosting Bot, LLC determines that the Rent to Own terms have been satisfied. The Rent to Own Terms are as follows; Customer must Maintain un-interrupted RTO product services for 12 consecutive months. Customer must not have any Hosting Bot, LLC Abuse Tickets filed against them. The following causes the client to IMMEDIATELY become ineligible from the RTO term and converts the service to a rented status; Reciept of a Verified Abuse Compalaint on the RTO Service; Violations to Hosting Bot, LLC's Terms of Service; Any Suspension on the RTO Service. The client has sole responsibility for contacting support for transfer of the server to colocation at a price determined by the sales team (normally less then RTO cost) or to request cancellation and shipment of server (at client's expense). Failure to adhere to the RTO Terms will make the client ineligible for a refund for any payment made towards the RTO Service.
Colocation Contractual Agreement:
All colocation plans that are ordered after November 2023 are subject to a 12-Month contract automatically. Should cancellation be submitted prior to the end of the service contract, any remaining balance will become immediately due. Only Hosting Bot, LLC Management may waive the contractual agreements unless otherwise required by law.
Unmetered Policy:
Any product sold with the description of unmetered bandwidth is done so at a 100Mbps 95th Percentile rate. If an additional 95th Percentile rate is needed, it can be purchased via ticket at a rate of $0.35 per Mbps. Any product that is discovered to have gone over their 100Mbps 95th Percentile rate without prior approval of Hosting Bot, LLC, will be charged the difference at the $0.35 per Mbps rate.
Bandwidth Overage Policy & IP Blacklist Policy:
Going over your set bandwidth will result in a fee being charged to you at a rate of $5 per TB. If you notice you are getting low on bandwidth, we strongly suggest contacting our support and requesting additional bandwidth for purchase, which will be at a cheaper rate than the going over. You will be charged a fee of $15.00 per IP that is blacklisted, if an entire IP subnet is blacklisted after routing, the client is held solely responsible and will be charged a fee of $150.00 per IP Subnet that is blacklisted. If an ASN level ban is assessed, the client responsible for the abuse will be charged a fee of $1500.00 plus any costs associated with cleaning the IPs.
Termination:
Hosting Bot, LLC reserves all rights to terminate your server or service upon any violation of these terms or any other basis if deemed necessary.
Threats/Abuse/Staff Abuse:
Using the Hosting Bot, LLC services to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property. Harassment Using the Hosting Bot, LLC services to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another. Sending or posting hateful, rude, or threatening messages to staff or company may result in termination. If you are found doing the following to our staff members cussing or making threats via the ticket system or discord support will result in service suspension or termination of your services.
Forgery, Impersonation and Invalid Information:
Adding, removing, or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. Any information that is not considered valid must be updated or risk account suspension and termination without refund.
Unauthorized access:
Network disruptions and unfriendly activity. Use of Hosting Bot, LLC’s service for any activity which affects the ability of other people or systems to use Hosting Bot, LLC’s services, or the Internet. This includes “Denial of Service” (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, services, or equipment is prohibited. It is the Member’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual’s cancellations must be submitted computer system will result in immediate account termination. Hosting Bot, LLC will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
Fraud:
Fraud involves a knowing misrepresentation or misleading statement, writing, or activity made with the intent that the person receiving it will act upon it. Fraud is strictly prohibited and offenses will be investigated. Third-party Links, Sites, and Services Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Hosting Bot, LLC. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third-party website, service, or content from Hosting Bot, LLC, you do so at your own risk and you agree that Hosting Bot, LLC will have no liability arising from your use of or access to any third-party website, service, or content. This now applies to any client that doesn’t submit a cancellation request. Failure to submit a cancellation request with Hosting Bot, LLC will result in your information being submitted to FraudRecord and MaxMind.
Backups and Data:
Hosting Bot, LLC is not responsible for any data loss. You are responsible for all backups on the following services; Virtual Private Servers, Hybrid Server, and Dedicated Server hosting. Hosting users are provided backups per request.
Service Suspension:
Hosting Bot, LLC reserves the right to immediately disable or terminate any product that is unpaid, immediately, subsequent to the end of a paid term. In the event that a product offering remains unpaid, Hosting Bot, LLC will remove any customer information from our servers after 3 days.
Banned Services:
All of the services provided by Hosting Bot, LLC will only be used for lawful and moral purposes. All Hosting Bot, LLC clients agree to indemnify and hold Hosting Bot, LLC harmless from any claims ensuing from the use of our services. All the following services or activities are strictly prohibited at Hosting Bot, LLC; Creating/Maintaining Multiple Accounts on https://clients.hostingbot.net, Intentionlly/Knowingly By-Passing Promotional Code/Offer rules, IRC Servers, Cracked Copies of Software / Licenses, Traffic Exchange, HitLeap, Crawlers, iMarcos, AutoSurf etc. Pirated Content / Warez / Topsites / Illegal Content, Email Spam/Sending of any type that causes blacklisting, Investment Sites (HYIP, FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme), Lottery / Gambling Sites / Bank Debentures / Bank Debenture Trading Programs, Fraudulent / Phishing / Replica Sites, Virtual Currency Mining (including but not limited to Bitcoin), DDoS-prone applications or booters/flood scripts / IP spoofing software, IP Scanners / Port Scanning or Bruteforce Programs, QEMU / Nested virtualization and related (on VPS/VDS products only), Cracking tools / illegal software key generators, Programs that cause hardware resource/network abuse in access of your specified plan. The service may be suspended and no refunds will be provided if the customer is found to be running anything listed above. This list is not exhaustive and is intended to give customers an indication of the types of uses that are disallowed at Hosting Bot, LLC. Any abuse that is reported to Hosting Bot, LLC and is verified by our abuse department will result in a $15 dollar account fine due immediately.
Indemnification:
The client agrees to defend, indemnify, and hold harmless Hosting Bot, LLC, its officers, directors, employees and agents, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from the client’s use of the Services or the client’s breach of this agreement.
Limitation of Liability:
Hosting Bot, LLC shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Hosting Bot, LLC’s servers going off-line or being unavailable for any reason whatsoever. Furthermore, Hosting Bot, LLC shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Hosting Bot, LLC’s servers. All damages shall be limited to the immediate termination of service.
Disclaimer of Warranties:
The Services are provided on an as-is and as-available basis. Hosting Bot, LLC makes no warranty, expressed or implied, including without limitation with respect to merchantability or fitness for a particular purpose. Hosting Bot, LLC makes no representation or warranty that the services will be uninterrupted, error-free, or completely secure.
Governing Law:
This agreement shall be governed by and construed in accordance with the laws of the State of Texas.
Collections:
Any balance left unpaid and overdue due to terms of service violations or breaches to these terms of service will not be canceled. The client authorizes Hosting Bot, LLC and it's billing officials to send invoices to collections and attempt payment with payment methods left on the account. Any chargebacks of collection invoices will result in additional fines up to $50 per chargeback.
Entire Agreement:
This agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes all prior and contemporaneous agreements and communications, whether oral or written, between the parties relating to the subject matter hereof. This agreement may not be amended or modified except in writing signed by authorized representatives of both parties.
